Strict Global Novelty (Section 4) India follows an absolute novelty rule—if your design was published anywhere before filing, it's not eligible. There is no grace period.
Excluded Subject Matter (Section 2(d)) Not eligible for registration:
- Designs that are purely functional
- Shapes not visible in regular use
- Commonplace or already known designs
Design vs. Copyright (Section 15 of Copyright Act) If your design (artwork) is reproduced more than 50 times, you need to register it as a design—not rely on copyright.
Enforcement Power (Section 22) Once registered, you can:
- Send legal notices
- File civil suits
- Claim damages or injunctions against infringers
