Refund and Cancellation Policy

At Sitabience IP Private Limited (“Company”, “we”, “our”, or “us”), client satisfaction is central to our services. This Refund and Cancellation Policy explains the terms under which refunds and cancellations may be considered for intellectual property-related services offered by us. By engaging our services, you acknowledge and agree to this Policy.
1. General Principles
- Our services are professional, knowledge-based, and time-sensitive in nature.
- Once initiated, such services involve significant investment of time, expertise, and resources. Hence, refunds and cancellations are limited and conditional.
- Clients are advised to carefully read the service description, scope, and fine print before engaging us.
2. Cancellation Policy
1. Change of Mind by Client
If a client unilaterally decides to cancel services after engagement, the Company will not be obligated to process a cancellation or refund.
2. Request to Hold Services
If a client requests us to place services on hold, the professional fee paid will be retained and kept valid for up to one (1) year from the date of payment. The service may be resumed during this period without additional charges, subject to changes in government fees or third-party costs.
3. Pre-Refund Completion Effort
- Before processing any refund request, we reserve the right to make our best efforts to complete the service.
- If, despite such efforts, the service remains incomplete and the refund is approved, a cancellation fee of 20% of the professional fee, along with:
- Earned fee for work already completed, and
- Any government or third-party charges incurred, shall be deducted before refunding the balance.
3. Refund Policy
1. Eligibility for Refund
- Refunds will be processed only if we are unable to deliver the promised service from our side, subject to internal investigation and verification.
- Requests must be submitted via email to mail@sitabienceip.com with complete details of the engagement.
2. Non-Refundable Fees
Refunds will not be provided for:
- Professional fees already earned due to work performed,
- Payment gateway or processing fees,
- Administrative charges,
- Government fees (e.g., filing fees, statutory charges, or taxes),
- Costs paid to third parties (e.g., translation, courier, notary, or database charges).
3. Refund Timeline
- Once approved, refunds will be processed within 30 days.
- Refunds will be credited only to the original payment method. For Stripe transactions, it may take 5–10 business days (depending on card issuer/bank) after processing for funds to reflect.
4. Ungovernable Factors
- Many IP-related processes depend on government authorities, registries, or third-party databases.
- Delays, rejections, objections, backlogs, or technical issues at such authorities are outside our control and shall not constitute grounds for refunds.
- Accordingly, refunds cannot be claimed for delays or outcomes that depend on external authorities' discretion.
5. Force Majeure
The Company shall not be liable for any failure or delay in performance or breach of this Policy due to circumstances beyond our reasonable control, including but not limited to:
- Natural disasters (earthquakes, floods, storms, droughts, fires, etc.),
- Epidemics, pandemics, or public health crises,
- Acts of war, terrorism, armed conflict, or civil unrest,
- Strikes, lockouts, boycotts, or labour disputes,
- Acts of government, changes in law, or judicial orders,
- Technical failures, power outages, or disruptions beyond our control.
6. Modification of Policy
This Refund and Cancellation Policy may be updated or modified at any time without prior notice. Clients are encouraged to review this Policy periodically to stay informed about applicable terms.
7. Governing Law and Jurisdiction
This Policy shall be governed by and construed in accordance with the laws of India, and any disputes shall be subject to the exclusive jurisdiction of the courts of New Delhi, India.
